CasitaMX is an online travel platform that connects guests with independent property owners and managers. We do not own, operate, or manage any of the properties listed on our platform. CasitaMX acts solely as a marketplace and booking intermediary. All rental agreements and property stays are the responsibility of the guest and the third-party host.
We may update these Terms at any time. Continued use of the Site after changes are posted constitutes your acceptance. You are responsible for reviewing the most current version of the Terms.
All reservations are subject to additional booking-specific terms, including:
Cancellation and refund policies
Guest responsibility for damages
Security deposit and dispute resolution
Host payout and commission terms
You agree to these terms when booking through the Site. It is your responsibility to review any policies that apply to your specific reservation.
By booking through CasitaMX, you acknowledge and agree that:
All properties are independently owned and operated by third-party hosts.
CasitaMX does not control, inspect, or certify the condition, legality, safety, or suitability of any property.
You assume all risks associated with staying in a private residence.
You release and hold harmless CasitaMX LLC, its employees, contractors, and affiliates from any claims, losses, injuries, or damages arising from your stay.
We strongly recommend purchasing travel insurance.
Each host is solely responsible for:
Compliance with applicable local laws, regulations, and tax obligations
Maintaining accurate listings and availability
Ensuring the safety, cleanliness, and legal operation of their property
Guest communication and support before, during, and after the stay
CasitaMX does not verify licensing, permits, safety features, or property conditions.
All content on the Site — including text, images, graphics, code, logos, and layout — is owned or licensed by CasitaMX and is protected by intellectual property laws. You may use the content for personal, non-commercial purposes only. Reproduction, modification, or redistribution without written permission is prohibited.
Any materials you submit to the Site (including feedback, photos, or comments), excluding personal identifying information, are considered non-confidential and non-proprietary. By submitting content, you grant CasitaMX a royalty-free, irrevocable right to use, reproduce, and publish it for any purpose.
You are responsible for anything you submit and agree not to upload content that is illegal, misleading, or harmful.
You agree not to:
Make false, speculative, or fraudulent bookings
Use automated systems to scrape or access content
Interfere with the operation or security of the Site
Attempt unauthorized access to systems or user data
Upload malware or any harmful code
The Site, platform, and all services are provided “as is” and “as available.” CasitaMX makes no warranties about the accuracy, availability, or reliability of information, listings, or services.
CasitaMX is not liable for:
Errors or inaccuracies in listings, pricing, or availability
Injuries, losses, or damages occurring at or related to any property
Actions, omissions, or negligence of any host or guest
Delays, disruptions, or failed transactions
Indirect, incidental, or consequential damages of any kind
If CasitaMX is found liable for any reason, our total liability will be limited to the greater of:
(a) the total amount you paid for the affected reservation, or
(b) $150 USD.
CasitaMX and its hosts are not responsible for any cancellations, delays, or changes caused by events beyond our control, including but not limited to:
Natural disasters
Severe weather
Power or utility outages
Government restrictions
Pandemics or health emergencies
Transportation or infrastructure failures
We do not guarantee refunds in these cases. You are strongly encouraged to purchase comprehensive travel insurance.
You agree to indemnify and hold harmless CasitaMX LLC, its employees, partners, and service providers from any claims, liabilities, losses, or legal expenses resulting from:
Your use of the Site or services
Your stay at a booked property
Your violation of these Terms or applicable law
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles. Any legal dispute must be brought exclusively in the courts located in Maryland, USA.
Nothing in these Terms creates a joint venture, partnership, agency, or employment relationship between you and CasitaMX. You agree that CasitaMX is an independent service provider and is not responsible for the actions of hosts or guests.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
