This End User License Agreement (“Agreement”) is a legal contract between you (“User,” “you,” or “your”) and CasitaMX Enterprises, Inc. (“Casita,” “we,” “us,” or “our”), governing your use of the casitahomes.com platform, including its web application, mobile applications, and any related software or services (collectively, the “Software”).
By creating an account, logging in, or otherwise using the Software, you agree to this Agreement. If you do not agree, do not access or use casitahomes.com.
Casita grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Software solely for your personal or business use in connection with managing or booking vacation rentals directly between hosts and guests. This license does not grant ownership rights in the Software.
You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or attempt to extract the source code of the Software, except to the extent that such restrictions are prohibited by applicable law.
All rights, title, and interest in and to the Software, including all intellectual property rights, are owned by CasitaMX Enterprises, Inc. This Agreement does not convey any ownership rights to you.
You agree not to use the Software to:
Violate any law or regulation
Post, share, or upload false, misleading, or infringing content (including photos or videos)
Interfere with or disrupt Casita systems or networks
Attempt to gain unauthorized access to other accounts or data
Use the Software for any purpose other than managing or booking vacation rentals directly with other users
casitahomes.com is a software platform that enables direct interaction between hosts and guests. Casita is not an OTA (Online Travel Agency), broker, property manager, or intermediary. Casita does not process payments, mediate disputes, or hold funds. All transactions and communications occur directly between users.
Casita may suspend or terminate your access to the Software at any time, with or without notice, if you violate this Agreement or misuse the platform. Upon termination, all rights granted to you under this Agreement will immediately cease.
Casita may update or modify the Software at any time without prior notice. Updates may include improvements, bug fixes, or new features. Continued use of the Software after an update constitutes acceptance of the modified version.
The Software is provided “as is” and “as available.” Casita disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Casita does not warrant that the Software will be uninterrupted or error-free.
To the maximum extent permitted by law, Casita and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of the Software. Casita’s total liability under this Agreement shall not exceed the greater of one hundred dollars ($100) or the amount paid by you to Casita in the twelve months preceding the claim.
You agree to indemnify, defend, and hold harmless CasitaMX Enterprises, Inc., its affiliates, officers, employees, and agents from any claims, damages, or expenses arising from your use of the Software or violation of this Agreement.
This Agreement is governed by the laws of the State of Delaware, United States, excluding its conflict-of-law principles. Any dispute arising out of or relating to this Agreement or your use of the Software shall be resolved by binding arbitration in Wilmington, Delaware, in accordance with the rules of the American Arbitration Association. Each party shall bear its own costs unless otherwise required by law.
Casita may modify this Agreement at any time. The updated version will be posted on casitahomes.com, and continued use of the Software after any modification constitutes your acceptance of the revised terms.
